Investigations in Higher Education
Overview
Universities operate with significant governance, regulatory, and public accountability obligations that few other institutions face. When issues arise, whether workplace misconduct, a public interest disclosure, a cyber incident, suspected fraud or corruption, or a governance failure attracting regulator or parliamentary scrutiny, the response must be swift, rigorous, and defensible. The consequences of getting it wrong span legal liability, regulatory sanction, funding risk, and lasting reputational damage.
Clayton Utz brings together specialists from across the firm, workplace relations, risk advisory, cyber security, privacy, and public sector regulation, to provide universities with an integrated investigations and integrity capability. We regularly act as external investigators, fact finders, governance reviewers, and trusted advisors to universities across the country.
How we help
Our investigations practice supports universities across the full spectrum of complaints and disclosures, including:
External fact-finding investigations: conducting independent investigations into allegations of staff misconduct, sexual harassment, bullying, research integrity breaches, and other serious matters, providing robust findings that can withstand internal and external scrutiny
Public interest disclosure investigations: managing the end-to-end PID process including assessment of disclosures, investigation planning, witness interviews, report preparation, and advice on reporting obligations to oversight bodies such as the Ombudsman
Governance and regulatory investigations: advising university councils and governance bodies on complex matters at the intersection of employment law, institutional governance, and regulatory compliance, including TEQSA expectations and accreditation risks
Cyber incident response and data breach management: providing integrated legal and technical support for cyber incidents, including forensic investigation, regulatory notification, privilege management, and crisis communications, as well as proactive resilience programs and incident response simulation
Misconduct and disciplinary processes: guiding universities through code of conduct processes, disciplinary proceedings under enterprise agreements, and the management of associated legal risks including procedural fairness, privilege, and confidentiality
Investigation and compliance framework design: helping universities build and refine their internal complaint-handling, investigation, fraud control, and whistleblower frameworks to ensure they are fit for purpose under current legislative requirements
Tandem legal advice: providing privileged strategic advice alongside investigation functions, enabling universities to protect legal professional privilege while maintaining a transparent and defensible investigation process
Case Studies
Royal Commission Support
Engaged to support a Go8 University's response to the Royal Commission into Antisemitism and Social Cohesion, drawing on our extensive Royal Commission experience. Our work included document production and evidence management using advanced data intelligence technology, witness preparation, and strategic legal advice, all under compressed timeframes and significant public scrutiny.
Public Interest Disclosure Investigation
Engaged to conduct a PID investigation under the Public Interest Disclosure Act 2022 (NSW), including gathering information, making findings of fact on the balance of probabilities, and providing recommendations for next steps and organisational improvement. Our work required careful navigation of confidentiality obligations, stakeholder management, and coordination with the university's governance structures.
Governance, Misconduct and Academic Freedom
We have advised this University on a range of matters over more than a decade, including the management of multiple employee misconduct matters that intersect with WHS and academic freedom issues, the resolution of workplace conflict at preliminary and litigation stages, and the conduct of workplace investigations in a trauma-informed and sensitive manner.
National Redress Scheme Investigations
Appointed as external investigators for education bodies in relation to complaints under the National Redress Scheme for Institutional Child Sexual Abuse, conducting investigations consistent with the National Response Protocol framework. This work has involved planning and conducting sensitive investigations, interviewing witnesses, engaging with the Redress Scheme, and providing advice on legal obligations and investigation strategy.
Investigation of Sexual Assault Allegations
Investigated allegations of serious sexual assault in the university's Drama Department involving simulated sex scenes in drama productions. We deployed a dual Clayton Utz team: one team conducted the fact-finding investigation while the other provided privileged legal advice, including on mandatory reporting obligations and coordination with police in relation to a concurrent criminal investigation.
