Product Liability, Safety and Recalls in Consumer & Retail

Australia is a highly regulated market for product manufacturers and suppliers. It is important for companies looking at or operating in the Australian market to understand our product regulatory, liability and safety requirements.

Product liability disputes are on the rise and regulators are more focused than ever on compliance and consumer safety. These trends are driven by heightened public awareness of consumer rights, AI assisted investigations, well established plaintiff law firms and litigation funders and active regulators with clear enforcement priorities.

The ACCC exercises its product safety powers actively, enabled by mandatory reporting requirements for both product related injuries and product recalls. Navigating a recall or other product safety issue requires sound legal judgment, an ability to predict how events may unfold, and the ability to work alongside operational, regulatory and reputational considerations to deliver a coordinated response.

We advise manufacturers, importers, suppliers, distributors and retailers across the full product safety lifecycle - from pre-market compliance and post market risk audits to mandatory reporting, recall execution, regulator engagement and litigation.

We assist clients to:

  • Understand and navigate Australian product safety, compliance and recall obligations

  • Engage with the ACCC and specialist regulators such as the TGA, FSANZ and the state electrical safety regulators

  • Conduct voluntary and compulsory recalls

  • Manage crisis response and communications strategy

  • Defend product liability claims and class actions

  • Coordinate regulatory, insurance and litigation strategy

Our product liability experience spans a wide range of products including pharmaceuticals, medical devices, health technology, consumer health, chemicals, motor vehicles, consumer electronics, toys, sporting goods, food, homewares and financial products.
