Joshua specialises in complex and large-scale commercial disputes, including class actions. He is an experienced commercial litigator that has represented a diverse range of clients, including large ASX-listed organisations, private companies and individuals, across a broad range of disputes. His experience spans contractual claims, directors' duties claims, claims concerning financial service providers, property-related matters and regulatory investigations.

With a track record of achieving successful outcomes for clients across a variety of industries, Joshua is highly regarded for his pragmatic and commercially focused approach to the resolution of complex and sensitive issues.

Notable Work
  • Corporate Executive Defence: Acted for the former CEO and CFO of Dick Smith Holdings Ltd in defending directors' duties claims brought by receivers (which went to the High Court) and two shareholder class actions. The claims concerned the stock purchasing practices and accounting practices of Dick Smith over an extended period, being one of Australia's largest electronic retailers at the relevant time.

  • Count Financial Limited: Defended a class action in the Federal Court of Australia which alleged breaches of the Corporations Act, ASIC Act and Australian Consumer Law. The matter has broad implications for financial planners, particularly relating to whether they could receive commissions from product providers.

  • Brickworks Limited: Represented Brickworks in private antitrust litigation against BGC Australia alleging, amongst other things, that BGC unlawfully acquired a competitor as the acquisition substantially lessened competition in the market.

  • Chartered Accountants Australia New Zealand: Acted as Tribunal Legal Adviser for CA ANZ's Disciplinary Tribunal and Appeals Tribunal, which determine conduct complaints made against chartered accountant members.

  • * Subsidiary of ASX-listed company: Acted in a dispute relating to the exercise of power by a government department, alleging a misuse of power and misleading or deceptive conduct.
