The Western Australian Government is reviewing the Commercial Tenancy (Retail Shops) Agreements Act 1985 (WA) (CT Act).

Any changes to the CT Act will have implications for property developers, commercial landlords and tenants in WA.

The Government’s June 2022 Consultation Paper has flagged that the following key issues are under review:

  • leases covered by the Act
  • minimum 5 year terms
  • disclosure requirements
  • calculation of turnover
  • trading hours
  • contribution to marketing funds
  • first right of refusal
  • early termination due to severe financial hardship
  • dispute resolution
  • unconscionable conduct
  • impact of COVID-19 and other issues.

Consider making a submission

Interested parties should consider making a submission on the Consultation Paper before the closing date of Monday 8 August 2022.
