Overview

Svetlana Zarucki has over 20 years’ litigation experience in relation to governance issues on complex matters in the Federal, Supreme and High Courts and advisory experience. Svetlana began her career in restructuring and insolvency with expertise in commercial litigation and government advisory work.  Having been involved in a number of regulatory matters following the Royal Commission into Misconduct in the Banking, Superannuation and Financial Services Industry and subsequent enforcement actions she transitioned into practice in retail banking financial services regulation.  She now undertakes work across all areas of financial services regulation including consumer credit, retail banking, deposits and payments, privacy and Anti-Money Laundering and Counter-Terrorism Financing compliance. 

Notable Work
  • Bell Group: Acted for Law Debenture Trust Corporation p.l.c. in long standing and complex proceedings commenced in Western Australia relating to, among other things, the distribution of A$1.7 billion held by liquidators of The Bell Group Ltd and Bell Group Finance Pty Ltd.

  • Australian Securities and Investments Commission (ASIC): Part of the team that acted for ASIC in its high-profile civil penalty proceedings against former directors and officers of companies in the James Hardie Group, ABN60 Pty Limited and James Hardie Industries NV.

  • HIH Insurance Group: Acted in relation to the complex and high-profile recovery actions against auditors, actuaries, directors and others. The HIH Insurance Group collapsed in 2001 with a deficiency estimated between $5 billion and $7 billion.

  • ASIC investigations and enforcements: Assisted various financial services entities in responding to regulatory investigations and enforcement action.

  • Confidential client: Acted for a foreign exchange company in relation to its registration as an independent remittance provider and advised on various issues arising under the Anti-Money Laundering and Counter Terrorism Financing Act. 

  • Confidential client: Acting for a bank in relation to product migration on financial services regulatory aspects of a technology transformation, including the launch of a new digital and personal advice proposition as part of a multi-year roll-out of simplified platforms and offerings.

  • Resimac Ltd: Acting for Resimac Limited in proceedings in the Federal Court concerning hardship practices under the National Consumer Credit Protection Act and National Credit Code.

  • Due diligences: Conducting numerous due diligences in relation to consumer credit, unfair contract terms, privacy and Anti-Money Laundering and Counter-Terrorism Financing risks for both vendors and purchasers.
