Construction and Major Projects

WestConnex Project (Roads and Maritime Services): Katherine  advised RMS on all aspects of Stages 1 and 2 of the WestConnex Project. This project is the biggest road project to be delivered in Australia and will link Sydney's west and south-west with the CBD.

NorthConnex Unsolicited Proposal and Motorway upgrades (Transport for NSW and Roads and Maritime Services): Katherine advised the NSW Government on the unsolicited proposal for the F3 to M2 Link road project. Katherine was a key member of the Clayton Utz team advising the State on negotiations with Transurban and worked closely with Roads and Maritime Services to prepare the complex project deed and finalise a large range of contractual documentation.

Darling Harbour Live Project (INSW and SHFA): Katherine advised Infrastructure New South Wales and Sydney Harbour Foreshore Authority on all aspects of the procurement of redeveloped and new convention, exhibition and entertainment facilities within the Sydney International Convention, Exhibition and Entertainment Precinct Project at Darling Harbour.

M2 Upgrade (Roads and Maritime Services): Katherine advised RMS in connection with the $550 million  upgrade of the M2 Motorway, including the negotiation and preparation of the project deed and other contractual documentation.

Northern Territory Secure Facilities Project (Access Capital Advisors): Katherine advised ACA in relation to its bid to finance, design, construct, maintain and provide services to the new Northern Territory Secure Facilities Project.

ACT Courts Facilities PPP Project: Katherine advised the ACT Government on its first major infrastructure project to be delivered by a PPP.  The project is to design, build, and finance the new Supreme Court facilities and provide support services and maintenance to both the new facilities and the existing Magistrates Court for a period of 25 years.

Royal North Shore Hospital PPP (NSW Health): Katherine advised NSW Health on all aspects of the public tender for the $950 million Royal North Shore Hospital redevelopment, the biggest health PPP project ever carried out in NSW. The project comprises the design, construction, finance and maintenance of a new acute health services facility, a community health centre, a new multi-level car park and the refurbishment of existing health facilities by the private sector party. Katherine provided strategic advice on the PPP project delivery model and the procurement policies and procedures applicable in connection with drafting of the tender and attached project documents and continues to advise on commercial and performance management issues arising from the operation of the Royal North Shore Hospital.

Mater Hospital Redevelopment (NSW Health): Katherine advised NSW Government in connection with various issues arising in connection with the redevelopment of Mater Hospital in Newcastle, including property, leasing, variation and other contractual issues arising from the operation of the Hospital.

Chatswood Interchange (Transport Construction Authority): Katherine advised in connection with the Chatswood Transport Interchange Project, which involved the development of a new transport interchange, including retail and residential developments, at Chatswood railway station.

Kooragang Island Coal Terminal Lease (Regional Land Management Corporation and Newcastle Port Corporation): Katherine advised the RLMC/NPC in relation the long term lease to the Newcastle Coal Infrastructure Group over land located on Kooragang Island, Newcastle for the purposes of the construction and operation of Newcastle's third coal loading terminal. This required the negotiation and grant of complex staged coal loader leases (over wet and dry land) and dredging licences, including advising on common user access rights and expansion rights.
