Wendy Devine is a special counsel in our Government Services Group, with a particular focus on major infrastructure projects. Her expertise includes administrative law, public law, statutory interpretation and regulatory issues arising in the Government infrastructure context.

Wendy has provided extensive advice to Government clients on a range of key infrastructure projects, particularly on issues arising in the compulsory acquisition of land process under the Acquisition of Land Act 1967, Transport Planning and Coordination Act 1994, Transport Infrastructure Act 1994 and the State Development and Public Works Organisation Act 1971.

Major infrastructure projects: Wendy has advised both State and local government clients on a broad range of key Queensland infrastructure projects including water, electricity and hospital projects and significant transport infrastructure projects such as roads, motorways, ports, railway upgrades and busways. These projects have involved acquiring infrastructure corridors, declaring State Development Areas and advising on critical infrastructure easements.

 

Land issues and property acquisitions: Wendy's compulsory acquisition experience includes advising on issues arising under the Acquisition of Land Act 1967 and the State Development and Public Works Organisation Act 1971. This also involves advising on all aspects of the acquisition process including assessing, negotiating and resolving compensation claims.

 

Tenure and access issues: Wendy has a thorough understanding of land tenure in Queensland, including non-freehold land under the Land Act 1994. Wendy's expertise includes resolving appropriate tenure arrangements under the Transport Infrastructure Act 1994 for rail, busways, local government tollways and State toll roads.

 

Public and administrative law: Working with Government over a number of years, Wendy has developed a strong understanding of the administrative and regulatory issues that arise in the context of major infrastructure projects. In particular, Wendy provides advice on appropriate decision-making processes and managing judicial review risks as part of delivering major projects.
