Naomi Kelly is a Partner in our Construction & Major Projects Group who has over 15 years' experience as a specialist front-end construction and projects lawyer, acting for a wide range of clients across the construction, engineering, resource, energy, transport, and infrastructure industries.

Naomi's experience includes acting for government agencies, electricity transmission businesses, developers and contractors in a wide variety of projects and contract delivery methods, including construction, design and construction, fit-out and remediation projects, maintenance projects, project and construction management agreements, strategic and project alliances, large-scale property developments, road and infrastructure developments, PPPs and joint ventures.

While her role on these projects has been varied, it has included advising as to appropriate contract delivery methods and risk allocation, tendering issues, the application of procurement policy, industry briefings, contract drafting and negotiation, as well as contract administration issues.

Construction and Major Projects

Airport Link / Northern Busway: Member of team which provided strategic advice and detailed project advice for the Queensland Government in this transaction from its inception through the development of its business case to financial close and then into the contract administration phase. Naomi's role has included assisting in the preparation of advice and documentation for the requests for Expressions of Interest and the Request for Proposal documentation and tender process as well as drafting the project documentation and liaising with the technical team in the finalisation of the performance specification.

EastLink Project (SEITA): Part of the team advising the Victorian Government on the EastLink Project. Naomi's role has included advising on risk allocation, tendering processes, the drafting of project documents including the Concession Deed and independent reviewer documentation, and advising on various issues during the contract administration phase of the project.


North South Bypass Tunnel:
 Advised the Brisbane City Council in relation to this PPP project, which includes the construction of a 4.8 km tolled tunnel under the Brisbane River. Naomi was involved as part of the Clayton Utz team leading to the appointment of the successful bidder. Her role included preparing project documentation, including in relation to the appointment of an independent verifier, reviewing technical documentation, and negotiating with the project proponents.


Kupe Gas Project: 
Acting for the operator of the Kupe Gas Joint Venture in relation to the Kupe Gas Project, including on the design, construction and commissioning of the Project for an offshore platform, offshore pipeline, onshore production station and onshore pipeline which is being delivered on a project alliance basis. Naomi's role has included preparing and advising on various aspects of the Alliance Agreement, including ongoing contract administration.


Department of Defence Single LEAP:
 This PPP project, which consists of two phases, involves the Department of Defence seeking a strategic partner for planning the development, construction, maintenance and operation of new single residential accommodation and associated facilities, infrastructure and services at a number of Defence facilities. Naomi's role to date has included preparation of Request for Proposal documentation, review of technical requirements, involvement in the evaluation and contract negotiation phase, and ongoing project management advice.
