Michael has a broad public sector litigation practice - frequently advising and appearing for clients in judicial review proceedings, urgent interlocutory injunctions, appeals, merits review, criminal prosecutions and statutory appeal processes in jurisdictions across Australia.

Michael has particular expertise in regulatory/professional disciplinary law, and uniform, national law regimes including in the education and health sectors.

Administrative and Public Law

Judicial and merit reviews: Michael regularly appears on behalf of a variety of Queensland Government and Commonwealth Government clients in litigation at all levels – from merits review tribunals through to Supreme and Federal Court judicial review. He is often briefed to provide urgent drafting advice and assistance in respect of requests for Statements of Reasons in complex decisions, requiring consideration of large volumes of documents and incorporation of high-level executive/whole of Government policy. He regularly drafts extensive Statement of Reasons, with a focus on maximum defensibility from foreshadowed judicial review challenge.

National law regimes – Queensland: Michael regularly acts for a Queensland Government departmentadvising and appearing on a range of regulatory matters brought under its relevant national law regime, including matters relating to the suspension and cancellation of  approvals, and associated litigation including before QCAT, the Supreme Court of Queensland, and the Queensland Court of Appeal;

  • appearing in criminal prosecutions brought before the Magistrates Court relating to offences under the national law, including the first proceedings successfully brought in Australia for "failure to supervise" offences, and in the first successful proceedings in Queensland for the giving of false and misleading information to the relevant regulatory authority under the national law.

National law regimes – Commonwealth: Michael also appears across a wide scope of matters, appearing before first instance merits review tribunals in Queensland and a number of interstate jurisdictions) in professional disciplinary and merits review proceedings - including under the nationalised health practitioner regulatory regime.

Sports Law: Michael has extensive experience in the Rules of Racing for Greyhound, Thoroughbred and Harness Racing, and the general industry regime - having acted and advised in respect of multiple proceedings brought under the Rules. He was also heavily involved in the Queensland Greyhound Racing Industry Commission of Inquiry and subsequent implementation of recommendations.

Planning and Environment: Michael has acted for the State of Queensland in a number of judicial reviews brought challenging matters relating to strategic State asset and declared significant projects incorporating assessment under the State Development and Public Work Organisation Act 1971 (Qld), Sustainable Planning Act 2009 (Qld) and Environment Protection and Biodiversity Conservation Act 1999 (Cth). Michael has provided the State early stage strategic and drafting advice in respect of the assessment of these matters and also acted in the end-stage litigation.

Local Government and Councils: Michael regularly advises local governments and councils in respect of a wide variety of matters, including decision making, investigatory issues and natural justice considerations and issues of statutory interpretation. He acts in rate and charges challenges, and more recently was involved in successfully resisting judicial proceedings brought against one of Australia's largest local councils seeking to prevent the sale of a major public asset.
