Real Estate

Property acquisitions and disposals

 Mary acted for ING on its sale of Lakeside Joondalup Shopping City to Lend Lease as part of the sale of its $1.4 billion property portfolio (including overseeing the staged development and leasing prior to the sale). Mary now acts for Lend Lease in leasing the centre as well as the balance of its Western Australian shopping centre portfolio.

CSC: Mary acted for CSC in its acquisition of a 50% stake in QV.1 Perth CBD, and continues to act for CSC in connection with co-ownership arrangements.

AMP: Mary acted for AMP in its sale of 66 St Georges Terrace in the Perth CBD and in relation to the disposal of certain aged care facilities in Western Australia.

LEX: Mary acted for LEX in its sale of the IKEA superstore and ground lease granted by the airport operator at Adelaide Airport, and also undertakes the leasing work for LEX as landlord at the IKEA Centre in Perth.

Property sales and purchases:
Mary acts for clients in buying and selling various shopping centres, CBD office buildings and industrial properties. These disposals have more recently included the Bunbury Forum Shopping Centre, Phoenix Shopping Centre and Bankwest owned Perth CBD office buildings. The acquisitions have included the Midland Central bulky goods centre, Melville Plaza shopping centre, Duncraig shopping centre and South Lakes Shopping.

Insolvency disposals: Mary regularly acts for mortgagees or receivers and managers in disposing of real estate, including in relation to horticultural managed investment scheme assets.

Commercial property

Major retailer:
 Mary has acted for many years for a major retailer in relation to its diverse property portfolio in WA including supermarkets, discount department stores, petrol and liquor as well as the acquisition of shopping centre sites.

Corporate M&A:  Mary works closely with the Clayton Utz corporate teams in undertaking the real estate aspects of transactions.  This has included acting for Tru Blu in relation to the sale of its equipment hire business to Coates.

Bank of Western Australia:
 Mary has acted on a number of major transactions for Bankwest. These have included negotiating and finalising a comprehensive Heads of Agreement for its new head office at Raine Square Perth CBD (prior to the acquisition of Bankwest by the Commonwealth Bank of Australia) as well as in connection with a major data centre facility in Western Australia including negotiating the development agreement in connection with construction of the facility, the sublease and tripartite documentation with the development financiers.  Having undertaken the leasing of Bankwest's office premises in Sydney, Melbourne and Queensland, Mary continues to work with Bankwest as tenant in relation to retail banking premises around Australia.

Office tower and shopping centre landlords: Mary acts for various landlords (including Bankwest, Hawaiian Investments, Rifici Group and Lend Lease) in negotiations with tenants including anchor tenants.

Officer tower tenants: Mary acts for a number of major corporations in leasing premises in the Perth Central Business District.

Subdivision and estate work: Mary acts for the developers of the Ellenbrook and Capricorn joint ventures.

Energy and resources

Mary has helped resources clients to establish infrastructure for their mining operations. This has included acquiring land, negotiating land access and compensation agreements with other land owners, negotiating pipeline easements, co-ordinating assessment of native title and environmental issues and advising in relation to water supply arrangements.
