Marko Misko is a "front-end" construction lawyer. He has practised in various commercial aspects of major infrastructure projects, general construction work, and both public and private sector facilities maintenance and management outsourcings.

This has included drafting and reviewing tender and contract documentation, negotiating and finalising transactions, providing advice on probity and other issues arising during the tender process, and other general contract and ongoing project management advice. It has also included advising on contract structures and risk allocation, particularly in the context of large-scale infrastructure projects.

Construction and Major Projects

Department of Defence (Infrastructure Division): Managing Contractor Contracts for Major Base/ Facilities Redevelopments, major legal adviser to the Infrastructure Division on its standard-form and project-specific documentation for its major facilities projects over the past 10 years. Extensive involvement in preparing both generic and project-specific EOI/RFT and contract documentation for a wide variety of delivery systems for both the design and construction and the management and maintenance of facilities by Defence.

Melbourne City Link Project: Marko has advised on most aspects of this $2.2 billion public infrastructure project. This initially involved strategic advice on, and negotiation and drafting of, the documentation required for delivery of the project. It then involved ongoing advice to assist in all issues arising out of the delivery of the project. Marko’s role has included negotiating and drafting various contractual arrangements relating to design and construction, operation and maintenance, government participation, and the engagement of independent experts. He also has ongoing involvement in the administration of the various contracts which have been established.


Mitcham-Frankston Freeway Project:
 Marko is one of the key construction advisers to the Victorian Government on this $2 billion toll road. That role involves advising on the project deed, the underlying technical documents, the tender documents and process deed, the independent reviewer arrangements and other ancillary arrangements.


AustralAsia Railway Project:
 Marko was involved in the drafting and negotiation of the delivery and operation/ maintenance aspects of this landmark $1.3 billion project, which recently achieved financial close. This included extensive negotiation with the financiers to the private sector consortium and preparation of ancillary tripartite documents involving the financiers. Marko is now joint Client Relationship Partner to the AustralAsia Railway Corporation (being the statutory corporation set up to look after public sector interests on the project).


Sydney Olympic Stadium:
 Marko was heavily involved in the drafting and negotiation of the design and construct aspects of the project deed and the underlying design and construct contracts for the Olympic Stadium.


EDS (Australia) Pty Ltd:
 This privately funded infrastructure project included the design, construction and maintenance of a building by the private sector for use by the South Australian Government.

Etihad Stadium, Docklands, Melbourne: Marko was the financier's lead construction adviser for drafting, negotiating and finalising the development and construction documentation for the stadium.
