Litigation and Dispute Resolution
City of Gold Coast ‒ Representative Action: Bronwyn advised the City of Gold Coast on its defence of a representative action brought by 80 property owners. The dispute concerned Council's design and operation of a landfill, and the migration of landfill gas to an adjoining residential estate.
The dispute attracted media attention and required the sensitive management of a number of issues including Council's engagement with residents and planning for remediation works. The claim involved novel allegations of duty, technical expert engineering and valuation evidence, and procedural difficulties.
Brisbane City Council - Queensland Floods Commission of Inquiry: Bronwyn was part of the team advising Brisbane City Council during the Inquiry into the Queensland floods.
Notices issued to the Council involved the production of thousands of documents spanning over many decades, the preparation of witness statements (including statements on technical engineering issues), expert evidence and submissions. The documents and material were produced within a very confined period and ultimately no adverse findings were made against the Council.
Lehman Brothers Australia Limited: Bronwyn assisted in advising the Liquidators on the resolution of investor CDO claims and on a number of other issues arising from the collapse of Lehman Brothers including the establishment of a scheme of arrangement and insurance coverage.
Coal mining arbitration: Bronwyn advised on a number of claims forming part of a large arbitration concerning a coal mining operation in the Bowen Basin.
Corporate fraud: Bronwyn advised a national construction company on the investigation of a series of fraudulent transactions and successfully obtained Mareva injunctions against the responsible individuals and entities. She also acted for an alliance of companies on the confidential investigation of complaints regarding the tendering and award of service contracts.

Insurance and Risk
Major bank: Bronwyn advised a major Australian bank in relation to a complex insurance recovery in respect of a customer remediation program established following a Senate Inquiry into ASIC. Bronwyn assisted in a similar role in relation to an insurance coverage following the collapse of a financial advice company.
Lehman Brothers Australia Limited: Bronwyn assisted in advising the Liquidators on the resolution of investor CDO claims and on a number of other issues arising from the collapse of Lehman Brothers, including insurance coverage in Australia and the United States.
Surat Basin Railway: Bronwyn assisted with undertaking a legal review and advising on aspects of the liability insurance program for the construction of a railway in the Surat Basin.
Power & Water Corporation: Bronwyn advised PWC, a government owned power generation, distribution and retail business operating throughout the Northern Territory, in relation to claims for material damage and consequential loss under Industrial and Engineering Special Risks policies.
Lead contamination: Bronwyn advised in relation to potential liabilities and insurance cover as a consequence of lead contamination pollution in WA. .
