Environment and Planning

North West Rail Link (TfNSW): Andrew is a key team member advising TfNSW on environment and planning issues for all phases of this project including drafting and commenting on planning instruments and regulations; analysing the status of the existing staged infrastructure approval for the North West Rail Link; review and advice on two environmental impact statements (EIS) for construction and operation and the draft conditions of approval; referral of the controlled action under the Federal Environment Protection Biodiversity Conservation Act and, the operation of the Biodiversity Offset Policy to the project.

 

CBD and South East Light Rail Project (CSELR) (TfNSW): Andrew is advising on all environmental and planning aspects of the CSELR, including the appropriate planning pathway and the co-ordination of the environmental impact assessment process with project timeframes.

 

Roads and Maritime Services: Andrew is advising RMS in respect of the EIA process of Part 3A and critical SSI Projects, including the Cross City Tunnel, M7, M2 Upgrade, Inner West Busway, Windsor Bridge Replacement (including defending RMS in Class 4 Proceedings in the L&E Court challenging the SSI Approval) and Northconnex.

 

Sydney Water: Andrew is acting for Sydney Water in a very complex major land contamination matter involving proceedings in the L&E Court (the first Class 1 proceedings appealing against a management order under the Contaminated Land Management Act) and the Supreme Court (common law nuisance and negligence).

 

Ausgrid (formerly EnergyAustralia): Andrew advised on a range of environment, planning and property matters relating to the Botany Bay Cable project, which involved the upgrade of two existing sub transmission stations on either side of Botany Bay and the construction of an electricity cable under Botany Bay linking the stations together. He is also drafting a declaration under Part 3A, reviewing the EIA documentation under State and Federal legislation and advising on various maritime issues and the Ourimbah-Wamberal project which involved the construction of a 132kV transmission line in the Central Coast of New South Wales.

 

Endeavour Energy (formerly Integral Energy) – Vineyard to Rouse Hill upgrade: Andrew is advising on all aspects of the electricity transmission line upgrade, with particular emphasis on the review of EIA documentation. He successfully mediated Supreme Court proceedings concerning the scope of the terms of the easement in respect of the upgrade Project.

 

Australian Catholic University: Andrew acted for ACU in respect of a successful Class 1 appeal against a Planning Appeal Commission decision about the Part 3A project for the expansion of the Strathfield Campus.

 

City of Sydney: Andrew is advising the City of Sydney in relation to a proposed voluntary planning agreement with the developer at Green Square regarding the delivery of decentralised energy and heating, and the benchmarks in building performance.
