Overview

Recommended CPD point allocation: 3 points (excluding WA).

Where disclosing documents might not be in the public interest, public agencies can make a claim of public interest immunity over those documents.

The immunity operates to relieve government litigants from producing evidence where:

  • the evidence relates to matters of state; and
  • the public interest in its disclosure in the legal proceeding is outweighed by the public interest in preserving the secrecy or confidentiality of that evidence.

However, this is a complex area of law, and courts will closely scrutinise all claims.

In this half-day training session, our experienced team will guide you through the common law doctrine of public interest immunity, to help your agency pick up where claims can (and can’t) be made, and how the immunity can interact with other statutory obligations held by your agency.

We will also discuss best practice in drafting submissions and tips and tricks for successfully establishing a claim for public interest immunity.
