  • Key LPP rules and principles
    • Who is the client?
    • Advice and litigation privilege
    • The dominant purpose test

Session 2  Legal Professional Privilege Issues for Government

  • Government in-house legal teams;
  • LPP and government decision making; and
  • Emerging Issues.

Session 3  Waiver of Privilege

  • Waiver of privilege – express waiver and implied waiver;
  • Waiver in a government context;
  • Communications with third parties;
    • Common interest privilege; and
    • Joint interest privilege.
  • Voluntary disclosure of the substance of legal advice; and
  • Issue waiver.
