Governments spend significant amounts of money on purchasing goods and services and delivering projects.  The level of scrutiny in relation to how governments go about these activities is ever increasing.  Therefore, if you’re an officer involved in undertaking procurement or administering contracts in government, you need to master the things that we will cover in this workshop.

  • Senior managers who regularly have to make calls on the tough issues in contractual negotiations. 
 

What we will cover

 

Day 1  Procurement and Contract basics

  • Government procurement framework
  • Understanding Probity and the procurement process
  • Contract fundamentals - how are contracts formed and what forms do they take
  • Key contractual provisions – understanding key provisions such as time frames, KPIs, indemnities, intellectual property rights, insurance, limitation of liability, liquidated damages etc
  • Drafting tips.

Day 2 – Contract interpretation and management

  • Interpretation of contracts - what do the words mean?
  • Unfair Contracts regime - application to Government and the implications
  • Managing contracts - the principles of wavier, variation and estoppel
  • What to do when things go wrong - breaches, disputes and the model litigant policy
  • Termination.

Each day will have practical workshops, case studies and problem-solving exercises.

At the end of the workshop you’ll:

  • Understand how to conduct a procurement
  • Be more confident in preparing, negotiating and reviewing contracts
  • Know how to interpret a contract correctly
  • Understand the keys to good contract management and addressing non-performance.
