This workshop examines the key principles of statutory interpretation relevant to government officers of all levels. It also highlights hidden traps which often await the unsuspecting bureaucrat seeking to apply legislation.

Workshop agenda

This workshop will examine the structure of legislation and the fundamental principles of statutory interpretation of relevance to government officers, including:

  • Sources of statutory interpretation principles as found in relevant Interpretation legislation and case law
  • Fundamental common law rules of statutory interpretation
  • The role of explanatory notes, second reading speeches and other extrinsic material in statutory interpretation
  • Grammatical aids in statutory interpretation
  • The interpretation of repealing Acts, amending Acts and Acts incorporating other statutes
  • The role of legal assumptions in statutory interpretation
  • Syntactical assumptions and statutory interpretation
  • Practical examples and recent case law.
