Government Specific Program

This workshop will explore the practical issues that arise in negotiating and managing real property transactions in government and provide participants with new skills for achieving successful outcomes for those transactions.

Workshop agenda

This practical training workshop will explore:

  • An overview of land tenure in Queensland, including the differences between freehold and non-freehold land
  • How to successfully negotiate and manage common real property transactions, including sales, leases, licences, easements, covenants and related documents
    • Understanding the role of different documents and transactions, and effectiveness of heads of agreement and memoranda of understanding in real property transactions
    • Identifying the subject matter of a real property contract – how can I deal with it?
    • Managing expectations in a real property transaction, including threatened breaches and non-performance of obligations
    • Knowing the statutes and statutory requirements that affect real property transactions – how not to get caught.
  • Contracts for the sale of land
    • Disclosure requirements
    • Special conditions in sale contracts – how to draft them and how to make them effective
    • What obligations can be passed to a buyer?
    • Unregistered and informal arrangements with respect to land – how to deal with them
    • An update on legislation affecting sale contracts, including the Property Agents and Motor Dealers Act 2000 and the Land Sales Act 1984.
  • Leasing land
    • How to make a lease work successfully for the entire lease term
    • Considering common lease provisions, including rent and rent review, maintenance and repair, make good, insurance and indemnities
    • Managing disputes that arise under a lease
    • The dangers of informal occupancy arrangements
    • Current leasing issues, including “green” obligations.

Learning outcomes

Participants will emerge with new skills and a greater understanding of how to successfully negotiate and manage common real property transactions.
