Profile - Murray West

Key Points:

Murray specialises in the transport infrastructure, structured finance and property finance fields. Over the last 10 years he has acted for a range of both public and private sector clients, including government authorities, debt financiers, developers, private sponsors, borrowers, construction companies and operators.

Murray has recently been acting for the Australian Rail Track Corporation in its successful negotiations with the New South Wales Government for the lease of the non-metropolitan freight rail network in New South Wales and all associated land, interface and funding arrangements. This culminated in the signing of a historic agreement involving the expenditure of $1.32 billion in new and upgrading existing freight rail infrastructure in New South Wales over the next five years.

He was also the lead partner acting for the Northern Territory and South Australian Governments in relation to the $1.3 billion AustralAsia Railway Project between Adelaide and Darwin, the construction of which was completed earlier this year.

Murray was also part of the Clayton Utz teams acting for the RTA on the Cross City and Lane Cove Tunnel projects and the Westlink M7 tollway project.

These projects have involved complex issues involving land, rail and road corridors, advice on all land acquisition and interface arrangements, negotiation and documentation of arrangements with local councils, statutory authorities, land reserve trusts, aboriginal land councils and private parties, and the preparation of complex land corridor leasing arrangements. His expertise extends to reviewing and advising on operation and maintenance contracts.

Murray is an authority on the legal and probity issues associated with tender processes.

Murray is also experienced in significant debt financing and equity documents, joint ventures, tax and stamp duty effective financing, licensing arrangements and complex loan and security documentation.
