
Australian Securities and Investment Commission: since 2007 has acted for ASIC in its civil penalty proceedings against former directors and officers of companies in the James Hardie Group, ABN60 Pty Limited and James Hardie Industries NV. ASIC was success in the majority of its claims. Brigitte continues to act for ASIC in the appeals filed by 10 of the unsuccessful defendants against ASIC.
Australian Securities and Investment Commission: represented ASIC before the high-profile HIH Royal Commission.
HIH Insurance Group (in liquidation): over a period of 5 years, advised the liquidators of the HIH Insurance Group in relation to various recovery actions against auditors, actuaries, directors and others. The HIH Insurance Group collapsed in 2001 with a deficiency estimated between $5 billion and $7 billion.
Korda Mentha: acting for receivers appointed by one of Australia's trading banks over a company with a large land holding in western Sydney. The matter involves providing advice on a varied range of issues including property related and contract construction issues.
Herman Miller: advised Herman Miller in connection with the receivership of one of its largest Australian distributors.
Department of Immigration and Citizenship: conducting the Department's portfolio litigation, as well as other litigation-related matters including in proceedings against the Department for damages.
Centrelink: acts in appeals filed by the Secretaries of relevant Departments within the portfolio. This involves acting in all aspects of the proceedings including reviewing the decision and advising on merits of appeal, advising on evidence, gathering evidence, and appearing at the hearings (usually as advocates) in the AAT.
Department of Health and Ageing: advised the Department in a number of matters arising out of the aged care portfolio. This has involved providing the Department with a mix of statutory interpretation and general law advice and appearing for it in proceedings before the Supreme Court of New South Wales.
Migration Review Tribunal: acted for the Tribunal in the matter of Susaki v MIMIA, which involved a claim of contempt of court by the Migration Review Tribunal for alleged failure to comply with orders made by the Federal Court and an extension of time to appeal against a Federal Court judgment.
