The lawyers in our national Construction and Major Projects group work with clients on a wide range of often complex infrastructure, construction, engineering and contract mining projects.

We advise the full spectrum of participants, from owners, developers and project sponsors to Federal, State and Local Government agencies, financiers, project managers, consultants and contractors.  We know and understand the practical, as well as the purely legal, aspects of what all participants in major projects want to achieve, and have a particular expertise in Public Private Partnerships (PPPs) in complex economic and social infrastructure construction projects.  We remain the law firm of choice for PPP projects and continue to undertake more work in PPPs than any other Australian law firm.

Our national team is one of the largest dedicated construction practices in the Asia Pacific region, operating as a cohesive group of contentious and non-contentious lawyers.  Using skills and experience gained in the law and from areas that overlap traditional construction disciplines, we bring the big picture, practical perspective to our clients' projects.  We offer a depth and breadth of resources at both a national and international level, so we can work on the ground at the project site, and provide the most effective resource wherever it's required.

Our integrated team works together to ensure the seamless delivery of advice to our clients on all aspects of major projects and construction transactions, including:

  • advice on strategic objectives and market risks involved in the project, risk allocation, procurement methods and developing robust project finance, construction, operations and maintenance agreements;
  • ongoing advisory services when projects have commenced and construction is underway;
  • dealing with specific legal aspects in construction projects such as business case development, security of payment, disruptions, variations and quantum merit; and
  • dispute avoidance and resolution advice.

A key benefit to clients is our emphasis on dispute avoidance and minimisation. For disputes that cannot be avoided, we have extensive experience in both binding and non-binding dispute resolution including executive negotiation, expert appraisal, analysis or determination, mediation, mini-trial, adjudication, litigation and arbitration.
