Enforcement and Cartels

The Australian Government has made enforcement of anti-competitive conduct, in particular, the criminalisation of serious cartel conduct one of its priorities.

Our national cartel lawyers have extensive experience advising both international and Australian businesses and executives in relation to cartel investigations and prosecutions instigated by regulators, including the Australian Competition and Consumer Commission, US Department of Justice and the European Commission. The team's experience spans a range of industries including pharmaceuticals and healthcare, manufacturing, and airfreight.

We are experienced in advising on range of cartel related issues, including immunity or leniency applications, the conduct of investigations by the ACCC, litigation and other resolution strategies.

In addition, we advise in relation to class action proceedings, typically brought by third parties affected by the cartel conduct, following proceedings brought by the ACCC.

Our national cartel team is composed of specialists with particular interest and experience in managing white-collar crime proceedings, including proceedings for extradition.

The team also provides competition advice on general commercial matters which may lead to enforcement action being taken by the regulator. In addition, we understand and can assess the risk areas for businesses, and we regularly advise and implement tailored trade practice compliance programs and interactive training to reduce the likelihood of anti-competitive behaviour occurring.
